PODCAST RELEASE & PUBLISHING AGREEMENT

This Agreement is between Five Milestones LLC / Bright Era Publishing (referred to as the “Publisher”) and the undersigned participant (referred to as the “Author”).

By signing this agreement, both parties agree to the following terms regarding the Author’s participation on the Milestone Moments in Business & Leadership podcast and the upcoming collaborative book project (the “Book”).

1. Podcast Recording & Media Release

The Author grants the Publisher the right to record, edit, publish, and share the Author’s voice, video, image, name, and bio from their podcast recording. The Publisher may use this content on its podcast, websites, social media, and promotional materials worldwide.

2. The “Speak-to-Book” Process & Publishing Rights

The Author understands that their spoken podcast interview will be transcribed and transformed into a written book chapter using PodToBook.ai. The Publisher agrees that the Author will have the opportunity to review, edit, and approve their chapter before it is published (as detailed in Section 3). Once approved, the Author grants the Publisher the right to format, publish, and sell this chapter as part of the Book in print, digital, and audio formats.

3. Timeline & Editorial Review Rules

To keep the book launch on schedule, both parties agree to the following timeline:

Draft Delivery: The Publisher aims to deliver the first written draft of the chapter to the Author within approximately seventy-two (72) hours of the recorded podcast interview.
15-Day Review Period: The Author has exactly fifteen (15) days from the date they receive the draft to review it, make changes, and approve it to ensure they feel confident in the final product.
No-Response Rule: If the Author does not submit their edits or contact the Publisher within those 15 days, the draft will be deemed approved as-is, and the Publisher may proceed with publication.
Publisher Approval: While the Author is encouraged to refine their chapter, all final edits are subject to the Publisher’s review and approval to ensure quality and legal safety. The Publisher’s editor may suggest changes or ask questions to enrich the story.
Podcast Schedule: The recorded podcast interview will be published on the Milestone Moments podcast based on the Publisher’s production calendar.

4. Package Fees & No Royalty Payments

The Author agrees to pay the package fee as displayed on the Publisher’s checkout page or as otherwise agreed in writing (the “Milestone Moments Author Package”). This fee covers podcast production, professional editing, formatting, publishing, and book marketing. Because the Publisher immediately reserves the Author’s spot and prepares resources, any paid fee is non-refundable once the interview is scheduled.

If the Publisher waives this fee as part of a special promotion or invitation, the other terms of this Agreement still apply in full. The Author explicitly agrees that they will receive no royalties, residuals, or financial payments of any kind from the ongoing public sales of the Book.

5. Book Purchases At-Cost

While physical copies of the book are not included in the standard entry package, the Author has the right to purchase print copies of the book at wholesale print cost (plus shipping and handling). The Author may buy these books during the launch window and up to three (3) times per calendar year. The Author may resell these physical books at retail price and keep 100% of the profits.

6. Copyright & Ownership of Stories

Your Story: The Author retains ownership of their personal story, experiences, and concepts. The Author is free to repurpose their story for blogs, coaching, or other projects, as long as it does not directly compete with or hurt the collaborative book launch.
The Book: The Publisher retains exclusive copyright and ownership of the Book as a whole (including the title, formatting, cover design, compilation, and distribution rights).

7. Release of Liability

The Author releases the Publisher, its team, and its agents from any and all liability or claims arising from the recording, editing, publication, or promotion of the podcast and the Book.
